RetroKid 2021– Chance to Win a Custom Space Jam:  New Legacy  BMX Bike (the “Contest”) Rules and Regulations

  1. SPONSORED:

The Contest is sponsored by RetroKid (the “Sponsor). Contest begins on Wednesday, July 7, 2021 at 21:00 p.m. Eastern Time (ET) and ends on Tuesday, Aug 31, 2021 at 11:59:59 p.m. (ET) (the “Contest Period”). NO PURCHASE NECESSARY. The "Contest Period" runs from the Contest Opening Date to the Contest Closing Date. The Contest is subject to all applicable federal, provincial, and local laws and regulations, and is void where prohibited.

  1. ELIGIBILITY

The Contest is open to all legal residents of Canada (with the exception of the Province of Quebec, where it is void) and the 50 United States (including the District of Columbia) who have reached the age of majority in their province, state, or territory at the time of entry. For further clarity, this contest is not open to residents of Quebec, Puerto Rico, or anywhere outside Canada and the United States.

The Contest is not open to the Sponsor or its parents, related and affiliated companies, Warner Bros. Entertainment Inc, advertising and promotional agencies, or employees, officers, directors, representatives, agents, successors or assignees thereof (collectively the "Contest Group"), or any persons residing in the same household with members of the Contest Group. By entering the Contest, entrants agree to abide by these Official Rules and all decisions of the Sponsor, which shall be final and binding on all entrants in all matters pertaining to the Contest. The Contest is governed by Canadian and United States law and is subject to all applicable federal, provincial state, and territorial laws and regulations. The Contest is void where prohibited by law.

  1. HOW TO ENTER

There are three ways to enter the Contest: Method 1 - Online Entry, Method 2 – Online Entry with Purchase, or Method 2 - Mail-In Entry.

Method 1 - Online Entry – Each entry from this method is worth (1) contest entry: To enter the Contest online, participants will need to:

a) Enter via the internet by going to www.retrokidbikecontest.ca (the “Contest Website”) and following instructions to the contest entry page.

b) Complete the entry form on the Contest Website by filling in your name, mailing address with postal code, e-mail address, telephone number, and date of birth.

c) Then submit the entry form by clicking on the “Submit” button. Administrator’s computer is the official time keeping device for the Contest. Online entries must be received by 11:59 p.m. (ET) on Tuesday, August 31, 2021. Entries submitted after the Contest Period has ended will not be accepted.

Method 2 - Online Entry with Purchase - Each entry from this method is worth (5) contest entries: to enter the Contest online following a purchase from the RetroKid.ca website, participants will need to:

a) Go online and go to www.retrokid.ca  (“The Sponsor Website”) and follow instructions to purchase RetroKid Space Jam: A New Legacy merchandise. Upon confirmation of that purchase, you will be provided a link to the Contest Website where you can follow instructions to the contest entry page.

b) Complete the entry form on the Contest Website by filling in your name, mailing address with postal code, e-mail address, telephone number, and date of birth. Please ensure the email address you are using with this method matches the email used to make your purchase on www.retrokid.ca.

c) Then submit the entry form by clicking on the “Submit” button. Administrator’s computer is the official time keeping device for the Contest. Online entries must be received by 11:59 p.m. (ET) on Tuesday, August 31, 2021. Entries submitted after the Contest Period has ended will not be accepted.

Method 3 – Mail-in Entry – Each entry from this method is worth (1) contest entries: No purchase is necessary to enter the Contest by following these steps:

a) For a chance to win without purchase, participants should write a unique 50 to 100 word essay on their favorite childhood memory, hand print his/her name and complete mailing address, e-mail address, phone number and birth date on a 8.5" x 11" piece of paper (mechanical reproductions void) , and mail the Essay to the address directly below. Essays must be received by Monday, August 16, 2021 in order to be eligible to enter Contest. There are no limits to the number of Essay entries per person provided that each Essay is submitted in its own outer envelope bearing sufficient postage. The Sponsor’s contest management company will enter the Contest on your behalf with the e-mail address you provided. An e-mail then will be sent to that e-mail address only to notify you if you have potentially won a Grand Prize. This notification will indicate that the prize will only be awarded pending successful verification and correctly answering the skill-testing question (for Canadian citizens). If the e-mail address provided is not valid or is unreadable then your entry will be void.

  1. PRIZES

a. Grand Prizes:  There is one (1) Grand Prize available to be won. Each Grand Prize consists of one (1) Custom Space Jam: A New Legacy BMX Bike.

The approximate retail value of each Grand Prize is $4,000.00 CAD

The total retail value of all of the Grand Prizes is $4,000.00 CAD

All Prizes must be accepted as awarded without substitution and are not transferable, refundable, for resale or convertible to cash unless as otherwise stated in the Official Rules.

The Sponsor reserves the right, in the event that a Prize, or any component of a Prize, cannot be awarded as described for any reason, to substitute the same for another prize or component of equal or greater value without liability.

  1. ODDS OF WINNING

a. Grand Prize: The odds of winning a Grand Prize will depend on the total number of entries received.

The total maximum number of Grand Prizes available to be won is One (1).

b. Entry: There is a limit of one (1) entry per household per week, regardless of the method of entry.

 

c. Entry submissions: Each entry method will result in a different number of entries into the contest.

 

Method 1 – Online Entry. Each entry from this method will receive one (1) entry into the contest

Method 2 – Online Entry with Purchase. Each entry from this method will receive five (5) entries into the contest. To receive the 5 entries for this method, the email address you use MUST MATCH the email address you used to make the purchase on www.retrokid.ca . These emails will be matched up and 5 entries will be given for each different purchase transaction (regardless of the number of items purchased on that transaction).

Method 3 – Mail-in Entry. Each entry from this method will receive one (1) entry into the contest.

RetroKid is not responsible for any entries that are lost, late, incomplete, illegible, or misdirected.

6.  SELECTION OF PRIZE WINNERS AND PRIZE CLAIM

a. Grand Prize Draw: A random draw for One (1) potential Grand Prize winner will be held on September 8, 2021 at 10:00 a.m. (ET) in Toronto, ON, Canada by an independent contest organization from among all eligible entries received during the Contest Period. The odds of winning a Grand Prize will depend on the total number of eligible entries received during the Contest Period.

  1. Three (3) attempts will be made to contact the selected entrant at the email address and two (2) attempts at the phone number provided on their entry form between 9:00 a.m. and 5:00 p.m. ET during a period of seven (7) days following the draw. If the selected entrant cannot be contacted within seven (7) days, by either email or phone, he/she will be considered to have forfeited the Grand Prize and will be disqualified and another entrant may be drawn from the remaining eligible entries until such time as contact is made with a selected entrant or there are no more eligible entries, whichever comes first. The sponsor or contest administrator will not be responsible for failed attempts to contact a selected entrant.

 

b. Claiming a Winning Prize: To be declared a winner, the selected entrant will be required to sign a Declaration and Release Form (the “Release Form”) confirming compliance with the Official Rules, that they accept the prize as awarded without substitution, and releasing the Sponsor, the Contest Administrators, and Warner Brothers and each of their respective shareholders, directors, officers, employees, subsidiaries, affiliated and related companies, successors and assigns (collectively, the "Released Parties") from any liability in connection with any Prize or the Contest. If the winner is Canadian, as part of the Declaration and Release Form they will be required to correctly answer a skill-testing question.

 

Each selected entrant must return a signed Release Form within ten (10) days of receipt, or he/she will be disqualified from receiving the Prize and another entrant may be selected from the remaining eligible entrants until such time as a winner is chosen or there are no more eligible entrants, whichever comes first. The Sponsor will contact each Prize winner within thirty (30) days of receiving his/her signed Release Form to arrange delivery of the Prize.

 

Please allow up to 8 weeks for delivery of the Prize from the end of the Contest Period.

 

The refusal by any potential winner to accept a Prize (or any portion thereof) releases and forever discharges the Released Parties of all obligations related to the Prize, including delivery. If a potential winner is found to be ineligible, declines to accept the Prize, or in the event that the Prize confirmation or Prize itself is returned undeliverable, the Prize will be forfeited and an alternative eligible entrant may be drawn from the remaining eligible entries at Sponsor's sole discretion.

  1. CONDITIONS OF ENTRY

All entries become the property of the Sponsor and will not be returned.

Any use of automated devices is prohibited. Entries attempted by methods other than those described in these Official Rules shall be deemed void. Any attempt by any participant to obtain more than the stated number of entries by using multiple/different e-mail addresses, identities, registrations and logins, or any other methods will void that participant's entries and that participant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification.

In the event of a dispute as to any registration, the authorized account holder of the e-mail address used to register will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. A selected entrant may be required to provide Sponsor with proof that he/she is the authorized account holder of the e-mail address associated with the selected entry. Proof of sending will not be deemed to be proof of receipt.

Sponsor also reserves the right at its sole discretion to disqualify from this Contest, and any future contest or other promotion Sponsor conducts, any individual that it finds or believes to be tampering with the entry process, or the operation of the Contest or Contest Website, to be acting in violation of the Official Rules or in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.

Any attempt by an entrant or any other person to deliberately damage any website used in association with the contest, or undermine the legitimate operation of the contest is a violation of criminal and civil laws and should such an attempt be made, sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.

  1. CONSENT TO COLLECTION, USE AND DISCLOSURE OF PERSONAL INFORMATION

By entering the Contest and/or voluntarily providing your personal information, each entrant consents and agrees to the collection, use and disclosure of the entrant’s personal information by Sponsor and its third-party services’ providers for the purpose of administering the Contest and fulfilling the Grand Prizes. The Sponsor will not use an entrant’s personal information for any other reason, nor will the Sponsor otherwise disclose it to any third party without consent of entrant.   1. RELEASE

By entering the Contest, entrants agree that the Sponsor shall not be responsible or liable for any losses or injuries of any kind resulting from participating in the Contest or acceptance, possession and/or use or misuse of the Grand Prize, or any part thereof, and agree to release, discharge and hold harmless the Sponsor, Warner Bros. Entertainment Inc., and each of their parents, related and affiliated companies, employees, officers, directors, representatives, agents, and successors or assignees thereof (collectively, the “Releasees”) from all claims or damages arising out of entrant’s participation in the Contest and/or acceptance, use or misuse of the Grand Prize, or any part thereof. By accepting the Grand Prize, each prize winner agrees to the use of his/her name, city of residence, photograph and/or other likeness in any related publicity for Sponsor, in any medium, including presence on the Sponsor’s website, without further compensation or permission, worldwide and in perpetuity. Sponsor makes no representation or warranty that any identification, videotape, photograph and/or likeness of the winner will be broadcast or used otherwise in any manner. Warner Bros.   1. LIABILITY

All decisions of the Sponsor and the Contest’s administrator are final and binding in all matters relating to this Contest, and the Sponsor and the administrator shall not be held responsible for any accident, negligence, printing, administrative or other errors that may arise or occur in connection with the Contest. As well, Warner Bros. Entertainment Inc., its parents, related and affiliated companies, employees, officers, directors, representatives, agents, and successors or assignees thereof shall also not be held responsible for any accident, negligence, printing, administrative or other errors that may arise or occur in connection with the Contest. The Sponsor reserves the right to modify, amend, suspend, or terminate this Contest in whole or in part, at any time without notice and with no obligation or liability, subject to applicable law. If the Contest is terminated, in whole or in part, before the end of the Contest Period, the Sponsor reserves the right to select the winners in a random drawing from all eligible, non-suspect entries recorded and received by the Sponsor as of the date of the termination or the event causing or relating to the termination, as determined by the Sponsor in its own discretion.

The Contest Sponsor and affiliates are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Contest; (d) technical or human error which may occur in the administration of the Contest or the processing of entries; (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of any prize; (f) the security or privacy of information transmitted via computer networks; or (g) breaches of privacy due to interference by third party computer hackers or for any damage caused to or incurred by any eligible entrant or any other person by reason of any such event or occurrence. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Contest, unless it is not possible to award another entry due to discontinuance of the Contest, or any part of it, for any reason, in which case entrant will have no remedy against Sponsor. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims. Entries are subject to verification and will be declared invalid if they are incomplete, garbled, forged, falsified, altered or tampered with in any way.

  1. The Releasees shall not be liable to Prize winners or any other person for failure to supply any Prize or any part thereof by reason of any acts of God, any actions, regulations, orders, or requests by any governmental entity, equipment failure, terrorist acts, war, fire, unusually severe weather, embargo, labour dispute or strike, labour or material shortage, transportation interruption of any kind, or any other cause beyond the reasonable control of the Releasees. 
  2. Sponsor reserves the right, where applicable, to cancel, modify, suspend or terminate the Contest, to change any Contest draw dates and to modify these Rules at any time without notice, for any reason, including, without limitation, if, in the opinion of the Sponsor, in its sole and absolute discretion:
  1. fraud, misconduct or technical failures destroy or threaten the integrity of any portion of the Contest;
  2. a computer virus, bug, or other technical problem corrupts the administration, security, or proper conduct of the Contest; or
  3.  there is any accident or printing, administrative or other error of any kind related to the Contest.

 

11. TAX INFORMATION

  1. For United States winners, all federal, state, local, and other taxes on the Grand Prize and any other costs, use and expenses associated with the Grand Prize acceptance and otherwise not specified as being provided, are the sole responsibility of the applicable winner. A 1099 tax form will be issued to the Grand Prize Winner.

12. DISPUTE


All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of Ontario, Canada.
